The first provisions for maternity leave in Germany were made in 1878. An amendment to the Commercial Code instituted an employment ban (unpaid leave) for three weeks after giving birth.

In 1891, the first law on female employees was passed granting three weeks of paid leave after having a baby.

In 1950, East Germany passed the Law on the Protection of Mothers and Children and the Rights of Women, which provided for five weeks of leave before the due date and six weeks after birth.

The West German Maternity Protection Act passed in 1925, extending the leave period to six weeks before the due date and eight weeks after birth (twelve weeks in the case of a premature or multiple birth). These (West German) time periods are still in place in Germany’s current Maternity Protection Act.
